1. Customer Authorization
The customer confirms that they are the property owner, tenant with proper authority, property manager, authorized representative, or other person legally authorized to approve the requested work. The customer is responsible for obtaining any required permission from the property owner, landlord, HOA, property manager, association, or other decision-maker before work begins.
Bluecrest Pro Services is not responsible for disputes between the customer and any owner, tenant, HOA, landlord, property manager, neighbor, or third party regarding authorization, access, service approval, or service results.
2. Agreement to Care Instructions
The customer has read and agrees to follow all pre-service and post-service care instructions provided by Bluecrest Pro Services. These instructions may be provided through the website, estimate, invoice, text message, email, customer portal, or written service agreement.
Failure to follow care instructions may affect results and may limit or void any touch-up, warranty, return visit, or workmanship correction.
3. Accurate Property Information
The customer is responsible for providing accurate and complete information about the property, access, water source, pets, children, plants, pools, ponds, sensitive areas, fragile surfaces, known defects, previous repairs, and any areas that should not be cleaned, painted, touched, or serviced.
Bluecrest Pro Services is not responsible for damage, delay, reduced results, additional costs, or service limitations caused by inaccurate, incomplete, or undisclosed information.
4. Access to Property
The customer is responsible for providing safe and clear access to all work areas, including gates, driveways, parking areas, hose bibs, water sources, exterior outlets, and service areas. Gates must be unlocked, pets must be secured, and vehicles or personal items must be moved before arrival.
If Bluecrest Pro Services cannot safely access the work area due to locked gates, blocked access, unsafe conditions, animals, vehicles, other contractors, or lack of preparation, the service may be delayed, rescheduled, or canceled. A trip fee, rescheduling fee, or additional charge may apply.
5. Water and Utility Access
For exterior cleaning services, the customer agrees to provide access to a working outdoor water source unless otherwise agreed in writing. The customer is responsible for ensuring that water spigots, hose bibs, irrigation controls, electrical outlets, and other utilities are functional and safe to use.
Bluecrest Pro Services is not responsible for pre-existing plumbing problems, leaking hose bibs, broken valves, poor water pressure, faulty electrical components, or utility defects.
6. Customer Responsibility to Remove or Protect Items
The customer is responsible for removing, moving, covering, or protecting any items near the work area that they do not want damaged, wet, cleaned, stained, moved, or affected by pressure washing, soft washing, painting, window cleaning, or maintenance work.
This includes, but is not limited to:
- Vehicles, patio furniture, outdoor cushions, grills
- Potted plants, hanging plants, decorations, toys
- Doormats, hoses, extension cords, garden tools, outdoor rugs
- Flags, signs, holiday décor, fragile items
- Personal belongings, valuables, electronics, cameras, speakers
- Any loose or sensitive items
Items left in the work area may get wet, moved, cleaned, exposed to overspray, or affected by service conditions. Bluecrest Pro Services is not responsible for damage to items left in the active service area.
7. Children, Pets, Guests, and Other Trades
The customer is responsible for keeping children, pets, guests, visitors, tenants, employees, neighbors, and other trades away from the active work area during service and until surfaces are dry, safe, and ready for use.
Bluecrest Pro Services is not responsible for injury, exposure, contamination, slip-and-fall incidents, damage, or interference caused by people or animals entering the work area before, during, or after service.
8. Plants, Landscaping, Animals, and Water Features
The customer must disclose all sensitive landscaping, delicate plants, new sod, edible gardens, fruit trees, herbs, vegetable beds, ponds, fountains, fish, birds, reptiles, animal enclosures, aquariums, and water features before service begins.
Bluecrest Pro Services takes reasonable precautions to reduce risk to landscaping and animals, which may include pre-wetting, rinsing, controlled application, dilution, and customer instructions. However, plants and landscaping can be affected by heat, sun exposure, drought, irrigation issues, disease, pests, soil conditions, chemical sensitivity, prior damage, overspray, runoff, or other conditions outside the control of Bluecrest Pro Services.
The customer is responsible for watering plants before service and watering affected landscaping after service. For pressure washing, soft washing, and roof cleaning, the customer should water affected plants and landscaping for 1–2 days after service when appropriate.
Bluecrest Pro Services is not responsible for damage to undisclosed sensitive plants, edible gardens, aquatic life, animals, or landscaping conditions that were not identified before service.
9. Pools, Ponds, and Water Systems
The customer must disclose pools, spas, ponds, fountains, water features, fish, aquatic life, and related equipment before service. The customer is responsible for removing pool toys, floats, towels, furniture, and loose items from the service area.
Bluecrest Pro Services is not responsible for chemical imbalance, water spotting, pool contamination, pond contamination, filtration issues, aquatic life injury, or damage to pool or water-feature systems unless caused by proven negligence by Bluecrest Pro Services.
10. Pre-Existing Damage and Hidden Defects
Bluecrest Pro Services is not responsible for damage caused by or related to pre-existing conditions, hidden defects, improper installation, poor maintenance, age, weathering, moisture intrusion, defective materials, faulty construction, or prior repairs.
This includes, but is not limited to:
- Open windows or doors
- Failed seals
- Faulty weather stripping
- Leaking doors or windows
- Damaged vents
- Old or failed caulking
- Hidden leaks
- Improper installation
- Loose or peeling paint
- Oxidation & chalking
- Wood rot & rust
- Cracked concrete
- Loose mortar
- Damaged stucco
- Brittle screens
- Aged plastics
- Damaged roof materials
- Loose shingles or cracked tiles
- Failing gutters
- Damaged flashing
- Surfaces that cannot safely withstand cleaning
Cleaning, painting, or maintenance may reveal these conditions. The discovery or exposure of pre-existing damage is not considered damage caused by Bluecrest Pro Services.
11. Surface Condition and Results
Cleaning and painting results may vary based on age, surface condition, staining, moisture, prior maintenance, previous coatings, sun exposure, material quality, water quality, drainage, oxidation, porosity, and hidden defects.
Bluecrest Pro Services does not guarantee that old, stained, oxidized, damaged, faded, porous, neglected, or compromised surfaces will return to a like-new appearance.
Some stains may not be fully removable with standard cleaning, including but not limited to: rust, battery acid, irrigation stains, oil, grease, artillery fungus, hard water stains, mineral deposits, tannin stains, efflorescence, deep organic staining, chemical burns, paint overspray, oxidation, and mold or mildew staining embedded below the surface. Additional restoration work may be required and may be quoted separately.
12. Oxidation, Fading, and Delicate Materials
Some exterior materials develop oxidation, chalking, fading, or weakened finishes over time. Cleaning may reveal uneven color, streaking, fading, or finish failure that was already present but hidden by dirt, algae, mildew, or debris.
Bluecrest Pro Services is not responsible for oxidation removal, uneven appearance, faded paint, chalky siding, tiger striping, or finish failure unless oxidation removal or restoration is specifically included in the written estimate.
13. Roof Cleaning Disclosure
Roof cleaning may reveal or worsen visible signs of pre-existing roof conditions, including cracked tiles, loose shingles, worn granules, damaged flashing, leaks, previous repairs, deteriorated sealants, brittle materials, or weak roof areas.
Some algae, moss, lichen, and organic growth may lighten over time rather than disappear immediately. Dead growth may release gradually with rain and weather.
Bluecrest Pro Services is not responsible for roof leaks, water intrusion, cracked tiles, shingle granule loss, loosened materials, or damage caused by age, improper installation, prior roof damage, hidden defects, or fragile roofing conditions.
14. Painting Disclosure
Paint performance depends on surface preparation, product selection, surface condition, moisture, weather, humidity, temperature, airflow, prior coatings, and customer care after completion.
Bluecrest Pro Services is not responsible for paint failure caused by moisture intrusion, roof leaks, plumbing leaks, wood rot, substrate failure, poor prior coatings, contaminated surfaces, customer damage, third-party damage, sprinkler contact, weather exposure, or hidden defects.
Paint colors and sheen may appear different based on lighting, surface texture, product batch, surrounding colors, age of existing paint, and whether the paint is wet or dry. Touch-ups may appear slightly different from the surrounding area.
15. Lead Paint, Asbestos, Mold, and Hazardous Materials
The customer must notify Bluecrest Pro Services if the property was built before 1978 or if there is any known or suspected lead-based paint, asbestos, mold, hazardous material, contaminated surface, or unsafe condition.
Bluecrest Pro Services does not perform lead abatement, asbestos abatement, mold remediation, or hazardous-material remediation unless specifically stated in writing and performed under any required licensing or certification.
If lead paint, asbestos, mold, or hazardous materials are suspected, Bluecrest Pro Services may stop work, modify the scope, require testing, require a specialist, or decline the service.
16. Environmental and Stormwater Compliance
Bluecrest Pro Services may use reasonable best practices to reduce improper runoff, protect storm drains, manage wash water, and comply with applicable local, state, and federal environmental requirements.
The customer must disclose storm drains, drainage paths, retention ponds, lakes, canals, ditches, waterways, septic systems, wells, and environmentally sensitive areas before service begins.
Bluecrest Pro Services may refuse, delay, modify, or stop work if site conditions create a risk of improper discharge, environmental violation, unsafe runoff, or uncontrolled wastewater.
The customer agrees not to direct, request, or require Bluecrest Pro Services to discharge wastewater, chemicals, paint, debris, or contaminants in a manner that violates applicable law or local rules.
17. Weather, Delays, and Unsafe Conditions
Bluecrest Pro Services may delay, pause, reschedule, or cancel work due to weather, lightning, rain, wind, heat, wet surfaces, poor drying conditions, unsafe roof conditions, blocked access, equipment issues, utility issues, or any condition that may affect safety or quality.
Weather-related delays are not a breach of contract. Bluecrest Pro Services is not responsible for damage, delays, additional costs, or reduced results caused by weather or conditions outside its control.
18. Scope of Work
Bluecrest Pro Services is responsible only for the work specifically listed in the approved estimate, invoice, written agreement, or approved change order. Anything not listed in the approved scope of work is excluded unless added in writing and approved by both parties.
Small maintenance work includes only the items listed in the approved estimate. Bluecrest Pro Services is not responsible for hidden damage, code violations, structural issues, electrical defects, plumbing defects, roof leaks, pest damage, mold conditions, or problems outside the agreed scope of work.
19. Change Orders and Additional Work
If hidden damage, additional work, unsafe conditions, surface failure, access issues, or customer-requested changes are discovered, Bluecrest Pro Services may require a written change order, revised estimate, or additional payment before continuing.
Verbal requests, text approvals, email approvals, or written approvals may be treated as authorization for additional work when they clearly identify the requested change and customer approval.
20. Payment Terms
Payment is due according to the approved estimate, invoice, or written agreement. Unless otherwise stated in writing, balance is due upon completion of the agreed service.
Bluecrest Pro Services may require a deposit, progress payment, or advance payment for scheduling, materials, paint, supplies, equipment, or larger jobs.
Unpaid balances may result in late fees, collection activity, suspension of work, cancellation of future service, or legal action where allowed by law. The customer is responsible for returned payment fees, collection costs, and reasonable attorney's fees and court costs where allowed by law or contract.
21. Deposits and Scheduling
Deposits may be required to reserve the service date, purchase materials, or begin preparation. Deposit refundability, if any, will be stated in the approved estimate or written agreement.
Customer cancellations, access failures, weather delays, or rescheduling requests may affect the service date. Bluecrest Pro Services may charge a cancellation fee, trip fee, or rescheduling fee if the customer fails to prepare the property or provide access as required.
22. Permits, HOA Approval, and Property Restrictions
Unless specifically stated in writing, the customer is responsible for obtaining HOA approval, landlord approval, property manager approval, association approval, permits, parking permission, gate access, water access, and any other authorization required for the work.
Bluecrest Pro Services is not responsible for fines, penalties, delays, violations, neighbor complaints, HOA disputes, or approval issues caused by the customer's failure to obtain required permission.
If a permit, licensed trade, specialist, or code-compliant work is required, Bluecrest Pro Services may delay, modify, subcontract, or decline the work.
23. Photographs and Marketing
Bluecrest Pro Services may take before, during, and after photos or videos for documentation, quality control, training, insurance, dispute resolution, and marketing.
Bluecrest Pro Services will avoid intentionally displaying private personal information, addresses, license plates, or identifiable individuals without permission where practical. The customer may request in writing before service that photos not be used for marketing.
24. Customer Inspection and Claims
The customer is responsible for inspecting the completed work promptly.
- For pressure washing, soft washing, roof cleaning, window cleaning, and exterior cleaning services: report concerns within 48 hours of service completion.
- For painting services: report touch-up concerns within 7 days of service completion unless the written estimate states otherwise.
- For small maintenance work: report concerns within 7 days of service completion.
All concerns should be submitted with photos and a clear description of the issue. Bluecrest Pro Services must be given a reasonable opportunity to inspect and correct any valid workmanship issue before the customer hires another contractor, performs repairs, or alters the work.
Failure to provide timely notice and a reasonable opportunity to inspect or correct may limit or void any warranty, touch-up, return visit, refund, or claim.
25. Warranty and Touch-Up Limits
Any warranty, touch-up, correction, or return visit applies only to workmanship within the agreed scope of work. Warranty, touch-up, correction, or return visits do not cover:
- Customer, pet, or child damage
- Weather damage
- Sprinkler or irrigation damage
- Surface failure
- Moisture intrusion
- Hidden defects
- Third-party or other contractor damage
- Pre-existing damage
- New staining after service
- Rust, oil, minerals, tannins, or hard water returning
- Areas not in the original scope
- Conditions outside Bluecrest Pro Services' control
26. Limitation of Liability
To the fullest extent allowed by law, Bluecrest Pro Services' liability for any claim related to the service is limited to the amount paid by the customer for the specific service giving rise to the claim.
Bluecrest Pro Services is not liable for indirect, incidental, special, consequential, punitive, or loss-of-use damages, including but not limited to lost income, lost rent, business interruption, hotel costs, inconvenience, emotional distress, loss of enjoyment, or costs related to third-party contractors hired without giving Bluecrest Pro Services a reasonable opportunity to inspect and correct the issue.
Nothing in this section is intended to limit liability where such limitation is prohibited by Florida law.
27. Indemnification
The customer agrees to indemnify and hold harmless Bluecrest Pro Services, its owners, employees, subcontractors, and representatives from claims, damages, costs, fines, penalties, or expenses caused by the customer's failure to disclose property conditions, failure to prepare the property, lack of authorization, unsafe conditions, undisclosed hazards, third-party interference, pets, children, guests, other contractors, or customer-provided instructions that cause damage or violate applicable rules.
28. Right to Stop Work
Bluecrest Pro Services may stop, pause, refuse, or reschedule work if continuing would create a safety risk, environmental risk, property-damage risk, legal risk, payment issue, hostile work environment, or quality concern.
Bluecrest Pro Services may also stop work if hidden conditions, hazardous materials, structural issues, mold, lead paint, asbestos, electrical hazards, severe weather, blocked access, or customer interference prevent safe or proper performance.
29. Subcontractors and Assistants
Bluecrest Pro Services may use employees, helpers, subcontractors, vendors, or specialists to complete work when appropriate. Bluecrest Pro Services remains responsible for the agreed scope of work unless otherwise stated in writing.
30. Florida-Specific Contract Notices
Some Florida residential improvement contracts may require additional statutory notices, including construction lien notices, cancellation notices, deposit/start-date terms, permit information, or other disclosures depending on the type of work, contract amount, sales method, and property type.
If required by law, those notices should be included in the approved written estimate, invoice, or service agreement. These website care instructions are not intended to replace any required Florida statutory notice.
31. Governing Law and Venue
This agreement and any dispute related to the service shall be governed by the laws of the State of Florida.
Unless prohibited by law, any legal action related to the service shall be brought in the county where Bluecrest Pro Services is located, where the work was performed, or another Florida venue allowed by law.
32. Entire Agreement
The approved estimate, invoice, written service agreement, change orders, and customer care instructions together form the agreement between the customer and Bluecrest Pro Services.
If there is a conflict between the website care instructions and a signed written agreement, the signed written agreement controls.
33. No Waiver
Failure by Bluecrest Pro Services to enforce any term does not waive the right to enforce that term later.
34. Severability
If any part of this disclosure is found invalid or unenforceable, the remaining terms will continue to apply to the fullest extent allowed by law.
35. Final Notice
These care instructions and disclosures are intended to support safe service, clear customer expectations, and responsible business practices. Final terms should be confirmed in the approved estimate, invoice, or written service agreement.
